DWI / DWAI Penalties
New York State is extremely tough on drunk drivers. Under the current laws, penalties for a conviction on a DWI or DWAI-drugs charge may mean:
- Up to one year in jail, a one-year license suspension and a $2,500 fine for first-time offenders (misdemeanor)
- Up to four years in prison, an 18-month or longer license suspension and a $5,000 fine for a second DWI conviction within 10 years (felony)
- Up to seven years in prison, the possibility of permanent license revocation and a $10,000 fine for a third DWI conviction within 10 years (felony)
Is There a Defense?
DWI charges can be effectively challenged on the basis of a lack of probable cause for the stop, improper testing procedures or equipment, and inaccurate blood-alcohol test results. In some cases, these defenses can successfully be used to get charges dismissed or the charges reduced to a less serious traffic offense.
